Company Summary

In New York in 1952, Duro Dyne Machinery Corporation was founded. By 1954, it dropped the “Machinery” but business stayed the same, a sheet metal company manufactured products for the HVAC (Heating, Ventilating, and Air Conditioning) industry. 

• Part of Duro Dyne’s legacy is that it put new products onto the market, like flexible duct connectors. These connected separate sections of sheet metal and helped absorb noise from the airflow in the ducts. The Econ-o-Fab Duct Connector was known to contain asbestos fabric.

• Asbestos was known to be heat resistant and good at insulating, so it’s no wonder Duro Dyne added it into many of its products that would need to withstand high temperature airflow from inside the ductwork. 

• Another important aspect of sheet metal work is sealing between the ducts, and asbestos was also commonly added to sealant products.

• Duro Dyne manufactured such products, typically sold in cans like paint cans, and they were applied wet and then dried to form a seal. When the material was chipped or scraped away for repairs or other purposes, asbestos fibers could be released into the air.

• The company’s various asbestos products had their peak on the market in the 1960s and ‘70s. Today, Duro Dyne operates facilities in New York, Ohio, Colorado, and Canada.

In September 2018, Duro Dyne Corporation filed for Chapter 11 Bankruptcy in the District of New Jersey. It took 2 years for the bankruptcy plan to be approved and finalize the establishment of the asbestos bankruptcy trust.

The Duro Dyne Asbestos Trust began accepting claims in 2021.

In 2020, Duro Dyne created the Duro Dyne Asbestos Personal Injury Trust under its Chapter 11 Plan of Reorganization. The current payment percentage is 20%.

To date, 660 claims have been filed with the Duro Dyne Asbestos Trust. The Trust’s annual financial report for 2022 provided that over $580,000 has been paid in compensation so far.

Important Facts About Asbestos Trust Compensation for People with Asbestos Illnesses

Statutes of limitation specify how much time a person has to file a lawsuit. 

If a person waits too long, they lose the right to file a lawsuit. 

Every state puts limits on how long individuals have to file lawsuits on their own behalf or on behalf of a deceased loved one.  These laws are called Statutes of Limitation, and if you miss one, you will not be able to file any asbestos claims.

If you wait too long to file an asbestos trust claim, you’ll lose the right to do so.  Statutes of Limitation can be complicated in asbestos cases because a person typically doesn’t develop an asbestos-related illness until many years after he or she was exposed.

Statutes of Limitations are often not very straightforward in asbestos cases because there are questions about when the statute should start:

• Does “the clock” start when a person is diagnosed with an asbestos-related illness, or does it start when they find out their illness could have been caused by asbestos? 

• If they worked in Texas but now live in Missouri, which statute applies?
