Company Summary

In 1917, Thompson, Munro and Robins Chemical Company was founded by three business partners. The name was changed in 1923 to Thompson-Hayward Chemical Company and eventually, it became T H Agriculture & Nutrition, LLC (THAN).

• The company did not manufacture its own asbestos-containing products. It began as a producer of pesticides and herbicides throughout the 1940s and ‘50s.

• THAN started to function primarily as a distributor of raw asbestos in the 1960s when it partnered with Carey-Canadian Mines (a subsidiary of Celotex Corporation).

• It distributed raw asbestos fibers for approximately twenty (20) years, from 1960 through 1980. A notable customer was Bondex, a manufacturer of asbestos-containing construction materials.

• In 1981, THAN’s parent company sold a majority stake of its assets to a company called Harcros Chemicals, Inc. (formerly Harrisons and Crosfield PLC), and it is still a subsidiary of the company today.

THAN may not have manufactured asbestos products, but in functioning as a distributor of raw asbestos fibers it put numerous types of workers at risk. Employees of companies that ordered asbestos from THAN, such as Bondex employees, were among those at risk.

Factory and warehouse workers that were responsible for bagging or unbagging the fibers faced great risk of exposure. Similarly, workers that may have had to mix, manipulate, or clean up the fibers on construction sites or in plants and refineries were also at risk.

T H Agriculture & Nutrition describes its asbestos injury liabilities as “substantial” by the time it chose to file for Chapter 11 bankruptcy on May 28, 2008.

The company quickly reorganized and formed its trust the following year.

In 2009, T H Agriculture & Nutrition created the T H Agriculture & Nutrition Asbestos Personal Injury Trust under its Chapter 11 Joint Plan of Reorganization. The current payment percentage is 15%.

The Trust states that it “aims to provide fair, equitable, and substantially similar treatment” for all claimants. The purpose of the payment percentage is to help ensure that funds will remain available for future claimants.

In 2021, 6,999 claims were filed with the Trust, according to its annual financial report.

The report also details that $29,321,024 was paid out in claims in 2021, adding to a total of $780,261,962 that the Trust has paid since it was established.

Important Facts About Asbestos Trust Compensation for People with Asbestos Illnesses

Depending on where you worked, or how you were exposed to asbestos, you may qualify to file claims with more than one asbestos trust. These laws are called Statutes of Limitation. 

Statutes of limitation specify how much time a person has to file a lawsuit.

If a person waits too long, they lose the right to file a lawsuit. 

Every state puts limits on how long individuals have to file lawsuits on their own behalf or on behalf of a deceased loved one. These laws are called Statutes of Limitation, and if you miss one, you will not be able to file any asbestos claims.

The exact same thing applies with asbestos trusts: 

If you wait too long to file an asbestos trust claim, you’ll lose the right to do so. Statutes of Limitation can be complicated in asbestos cases because a person typically doesn’t develop an asbestos-related illness until many years after he or she was exposed.

Statutes of Limitations are often not very straightforward in asbestos cases because there are questions about when the statute should start:

• Does “the clock” start when a person is diagnosed with an asbestos-related illness, or does it start when they find out their illness could have been caused by asbestos? 

• If they worked in Texas but now live in Missouri, which statute applies?
