With the new legislation in place, military veterans would be eligible for compensation and free treatment of health conditions that developed as a result of their time in the service. The bill then passed the Senate by an 84-14 vote in June, and President Joe Biden vowed to sign it when it reached his desk. This seemed very<a href=\"https:\/\/ctmirror.org\/2022\/06\/21\/after-years-of-fighting-for-benefits-pact-act-offers-hope-to-veterans-exposed-to-burn-pits-and-other-toxins\" target=\"_blank\" rel=\"noreferrer noopener\"> promising<\/a> for veterans and their families.<\/p>\n\n\n\n<p>However, just this month, after technical errors were addressed in the original<a href=\"https:\/\/www.militarytimes.com\/veterans\/2022\/07\/27\/new-benefits-for-burn-pit-victims-in-limbo-after-senate-republicans-block-plan\" target=\"_blank\" rel=\"noreferrer noopener\"> measure<\/a>, it was sent back to the Senate, and in round two, Senate Republicans opted to<a href=\"https:\/\/www.cnn.com\/2022\/07\/27\/politics\/senate-burn-pit-bill-fails\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\"> block<\/a> it. They cited concerns over how the money would be allocated. Democrats were furious, and publicly stated that more veterans will die as a result.<\/p>\n\n\n\n<p>The future of the PACT Act is unknown. The measure is expected to eventually pass\u2014it\u2019s only a matter of time. But, unfortunately, time is not something that many suffering vets have.<\/p>\n\n\n\n<p>Although now back at home, vets continue to live the horrors of war, once again fighting for their lives after being routinely exposed to asbestos and other harmful substances. One of the most common means of exposure was the use of burn pits. What are burn pits, exactly, and why the need for treatment?<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-columns background_pampas is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column p-4 mx-3 is-layout-flow wp-block-column-is-layout-flow\">\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<h2 class=\"wp-block-heading\" id=\"h-toxic-burn-pits-expose-vets-to-1-000-known-carcinogens\">Toxic Burn Pits Expose Vets to 1,000 Known Carcinogens<\/h2>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<p>There have been more than 1,000 carcinogens identified in burn pits and, in April of this year, the U.S. Department of Veterans Affairs (VA) shared the nine most prominent respiratory cancers that have surfaced as a result of their use.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Veterans have developed cancers related to toxic burn pits, including:<\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li>Squamous cell carcinoma of the larynx<\/li><li>Squamous cell carcinoma of the trachea<\/li><li>&nbsp;Adenocarcinoma of the trachea<\/li><li>&nbsp;Salivary gland-type tumors of the trachea<\/li><li>&nbsp;Adenosquamous carcinoma of the lung<\/li><li>&nbsp;Large cell carcinoma of the lung<\/li><li>&nbsp;Salivary gland-type tumors of the lung<\/li><li>Sarcomatoid carcinoma of the lung<\/li><li>Typical and atypical carcinoid of the lung<\/li><\/ul>\n\n\n\n<p>The government indicated that it would process<a href=\"https:\/\/www.asbestosclaims.law\/asbestos-mesothelioma-claims\/veterans-disability-claims\"> disability<\/a> compensation claims for anyone who<a href=\"https:\/\/www.asbestos.com\/veterans\/military-branches\/#:~:text=Asbestos%20Exposure%20Across%20the%20Armed,aircraft%2C%20barracks%20and%20other%20buildings.\" target=\"_blank\" rel=\"noreferrer noopener\"> served<\/a> in the military in Southwest Asia dating back to August 1990 and is reporting having one or more of these cancers (or other chronic conditions) as well as those who have served in Afghanistan, Uzbekistan, Syria or Djibouti beginning September 19, 2001, to the present.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Veterans benefits and presumptive conditions<\/h3>\n\n\n\n<p>If a service person develops what is referred to as a \u2018presumptive condition,\u2019 according to PACT, like asthma or sinusitis, the<a href=\"https:\/\/www.asbestosclaims.law\/asbestos-symptoms-and-treatment\/asbestos-injuries\"> VA<\/a> automatically assumes that it was contracted during their time in the service because of its high level of prevalence. Shortness of breath, an unrelenting cough and chest tightness are some of the<a href=\"https:\/\/www.asbestosclaims.law\/asbestos-symptoms-and-treatment\/asbestos-injuries\"> symptoms<\/a> to look out for. Another condition that is presumed to be a cause of war includes<a href=\"https:\/\/www.woodslawyers.com\/pulmonary-fibrosis-va-disability\" target=\"_blank\" rel=\"noreferrer noopener\"> Pulmonary Fibrosis<\/a>, which occurs when lung tissue is damaged from breathing in toxins.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Burn pits seem to be largely to blame for many of the health conditions being reported.&nbsp;<\/h3>\n\n\n\n<p>Hazardous waste was routinely thrown into these pits and set aflame in an effort to \u201csafely\u201d get rid of it. The trash often included all of the following, in addition to other potentially harmful materials, and burning it was anything but safe:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Medical waste<\/li><li>&nbsp;Human waste<\/li><li>Construction waste<\/li><li>Wood<\/li><li>Metal<\/li><li>Rubber<\/li><li>Plastics<\/li><li>Aluminum<\/li><\/ul>\n\n\n\n<p>When fire was set to these materials, dust, debris smoke and fumes became airborne and there were often toxic particles released into the air. These particles could easily be accidentally ingested.<\/p>\n\n\n\n<p>Some of the materials discarded in the pits contained<a href=\"https:\/\/www.asbestosclaims.law\/\"> asbestos<\/a>. Asbestos particles, when airborne, tend to get lodged in the lining of the lungs. This can lead to not only all of the cancers listed above, but to other forms of cancer and chronic respiratory conditions, including asthma, rhinitis, sinusitis and more.<a href=\"https:\/\/www.mesotheliomavets.com\/blog\/cancer-linked-to-burn-pits\"> Mesothelioma<\/a>, a deadly cancer known to be caused by exposure to asbestos, is one of the most commonly reported cancers among service men and women.<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" width=\"1430\" height=\"510\" src=\"https:\/\/www.asbestosclaims.law\/wp-content\/uploads\/2022\/08\/Image-Pit-article-body-1.jpg\" alt=\"\" class=\"wp-image-10592\" srcset=\"https:\/\/www.asbestosclaims.law\/wp-content\/uploads\/2022\/08\/Image-Pit-article-body-1.jpg 1430w, https:\/\/www.asbestosclaims.law\/wp-content\/uploads\/2022\/08\/Image-Pit-article-body-1-540x193.jpg 540w, https:\/\/www.asbestosclaims.law\/wp-content\/uploads\/2022\/08\/Image-Pit-article-body-1-768x274.jpg 768w, https:\/\/www.asbestosclaims.law\/wp-content\/uploads\/2022\/08\/Image-Pit-article-body-1-18x6.jpg 18w\" sizes=\"(max-width: 1430px) 100vw, 1430px\" \/><\/figure>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column p-4 mx-3 is-layout-flow wp-block-column-is-layout-flow\">\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<h2 class=\"wp-block-heading\" id=\"h-does-the-pact-act-specifically-cover-asbestos\">Does the PACT Act Specifically Cover Asbestos?<\/h2>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<p>The short answer is, \u2018Yes.\u2019 Because<a href=\"https:\/\/www.publichealth.va.gov\/docs\/exposures\/va-ahobp-registry-data-report-april2015.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"> asbestos<\/a> is a known toxin and the act covers exposure to toxins, asbestos made the list. It has been found in burn pit debris and, while the U.S. banned the use of asbestos in the late-\u201880s, overseas there is far less regulation on its use and how to properly discard it. Because of this,<a href=\"https:\/\/www.asbestosclaims.law\/\"> burn pits<\/a> haven\u2019t been the only sources of asbestos exposure in the military. This is because<a href=\"https:\/\/www.asbestosclaims.law\/\"> asbestos<\/a> was used in multiple areas of ships, inside and out. Marines, according to the same study, were most susceptible to exposure in armored vehicles. And, while the places of exposure varied, in the end, all branches have been impacted.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Compensation for asbestos-related illnesses caused by burn pits while in military service<\/h3>\n\n\n\n<p><a href=\"https:\/\/www.asbestosclaims.law\/\">Asbestos<\/a> exposure compensation is currently available through the VA. But some have complained that their claims have been denied over the years. Unfortunately, symptoms of<a href=\"https:\/\/www.asbestosclaims.law\/\"> asbestos<\/a> exposure can take years to surface\u2014even decades.
